CHAPTER 4732 PSYCHOLOGISTS

§ 4732.13. License privileges.

A license issued by the state board of psychology shall remain in effect until suspended or revoked. A current, valid psychologist license shall entitle the holder to practice psychology. A current, valid school psychologist license shall entitle the holder to practice school psychology.

Negligence


A cause of action arising from the claimed negligence of a licensed independent social worker, a licensed psychologist or a licensed mental health care facility is not a claim for malpractice and is therefore not governed by RC § 2305.11: Thompson v. Community Mental Health Ctrs. of Warren Cty., Inc., 71 Ohio St. 3d 194, 642 N.E.2d 1102 (1994).



Property interest of practitioner


Under Ohio law, it is clear that a person has a property interest, or legitimate claim of entitlement, to practice psychology once he has been licensed, without being formally disciplined unless certain procedures have been followed: Wilson v. Moss, 537 F. Supp. 281, (S.D. 1982).



School psychologists


In the case of a licensed psychologist or a licensed school psychologist employed by a public school system, the requirements of the licensing laws applicable to school psychologists (RC Chapter 4732.), do not conflict with the regulations applicable to certificated school personnel but, rather, supplement them in that each governs a distinct, although related, aspect of the school psychologist's practice: OAG No. 75-047 (1975).
